Dude, pay attention to the news. That article is 3 days old. The Supreme Court threw out that case today. So it basically upholds the the Missouri Supreme Court ruling that allows fantasy leagues to use player names and stats.

NFL, NBA, NHL and NASCAR filed in behalf of MLB. But the lower court ruling agreed that fantasy league uses of stats is no different than "normal" media use.
